• שימוע

  פגישה שחייבת להתקיים לפני החלטה על פיטורים, שבה העובד מקבל הזדמנות אמיתית להשמיע את עמדתו. שימוע שנעשה למראית עין בלבד עלול להיחשב פגום.
  Hearing

  A meeting that must take place before a decision to dismiss, at which the employee gets a genuine opportunity to put their case. A hearing held for appearances only may be treated as defective.
  Entretien préalable

  Un entretien qui doit se tenir avant toute décision de licenciement, au cours duquel le salarié a une véritable occasion d'exposer sa position. Un entretien tenu pour la forme peut être jugé irrégulier.

  Notice period

  The period of advance notice required before employment ends. Its length depends on seniority, and its value may be paid instead of working it.
  Préavis

  La période de prévenance exigée avant la fin du contrat. Sa durée dépend de l'ancienneté, et sa valeur peut être versée au lieu d'être travaillée.

  סכום שמעסיק משלם לעובד שפוטר — בדרך כלל שכר חודשי אחד לכל שנת עבודה. חלק ניכר ממנו כבר נצבר בקרן הפנסיה.
  Severance pay

  A sum an employer pays a dismissed employee — usually one month's salary for each year worked. A substantial part of it has already accumulated in the pension fund.
  Indemnités de licenciement

  Une somme versée par l'employeur au salarié licencié — en principe un mois de salaire par année travaillée. Une part importante est déjà constituée dans la caisse de retraite.

  מסמך קצר שנחתם לפני החוזה המלא. בניגוד למה שרבים מניחים, הוא יכול להיות מחייב לחלוטין.
  Memorandum of understanding

  A short document signed before the full contract. Contrary to what many assume, it can be entirely binding.
  Promesse de vente

  Un document bref signé avant le contrat définitif. Contrairement à ce que beaucoup supposent, il peut être pleinement contraignant.

  Caution

  An entry on the land register telling anyone who checks that the property already has a buyer. It is the main protection against a double sale.
  Prénotation

  Une inscription au registre foncier signalant à quiconque le consulte que le bien a déjà un acquéreur. C'est la principale protection contre une double vente.

  Land registry

  The office where rights in property are recorded, and where the transfer is ultimately registered.
  Registre foncier

  Le service où sont inscrits les droits sur un bien, et où le transfert est finalement publié.

  מסמך בין שותפים בעסק חדש שקובע מי מחזיק במה, מי מחליט, ומה קורה כשאחד רוצה לצאת. נכתב כשכולם מסכימים, ונקרא כשכבר לא.
  Founders' agreement

  A document between partners in a new business setting out who holds what, who decides, and what happens when one of them wants out. Written while everyone agrees, and read when they no longer do.
  Pacte de fondateurs

  Un document entre associés d'une entreprise nouvelle précisant qui détient quoi, qui décide, et ce qui se passe lorsque l'un souhaite partir. Rédigé quand tout le monde s'entend, relu quand ce n'est plus le cas.
• סעד זמני

  החלטה שבית המשפט נותן במהירות, לפני שהתיק הוכרע, כדי למנוע נזק שלא יהיה אפשר לתקן אחר כך.
  Interim relief

  An order the court gives quickly, before the case is decided, to prevent harm that could not be put right afterwards.
  Mesure provisoire

  Une décision rendue rapidement par le tribunal, avant que l'affaire ne soit jugée, afin d'éviter un préjudice qui ne pourrait plus être réparé.
• התיישנות

  פרק הזמן שאחריו כבר אי אפשר להגיש תביעה. בתביעות אזרחיות רגילות — שבע שנים, ויש חריגים.
  Limitation

  The period after which a claim can no longer be brought. For ordinary civil claims — seven years, with exceptions.
  Prescription

  Le délai au-delà duquel une action ne peut plus être engagée. Pour les actions civiles ordinaires — sept ans, avec des exceptions.
• פשרה

  הסכם שמסיים סכסוך בלי פסק דין. רוב התיקים האזרחיים מסתיימים כך, ולרוב זה גם עדיף.
  Settlement

  An agreement ending a dispute without judgment. Most civil files end this way, and usually that is the better outcome.
  Transaction

  Un accord mettant fin à un litige sans jugement. La plupart des affaires civiles se terminent ainsi, et c'est le plus souvent préférable.
